Conditions of Use
1. General
All purchases, deliveries, and other services take place according to these conditions of use. "Livingtools" manages your information within the ordering transaction and all information pertaining to any offer strictly within privacy protection laws. There is no minimum purchase. More information regarding delivery is contained in the section regarding conditions of delivery.
Payment can be made as:
-Payment upon delivery (see conditions of delivery)
-Payment in advance (3% discount)
2. Use
"Livingtools" sells only to unrestricted, competent natural or legal persons. Information necessary for registration or purchase such as name, address, age, etc is to be given completely and truthfully. The customer agrees not to make public, share with a third party, or otherwise make accessible to unauthorized parties, his/her customer registration password. When a purchase is made and confirmed, all costs for the item and shipping at time of purchase come into effect.
Prices are valid as of the day of ordering. They are specified again in the online bill. All prices include value added tax, plus shipping costs / C.O.D. charges. "Livingtools" sends your bill by surface mail after you place your order.

Countries outside the EU - no value added tax; postage costs according to country, customs duty, tax
3. Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an online catalog without obligation. By providing your information and clicking the "order now" button you enter into a binding transaction purchasing the items in your shopping cart. You receive a computer-generated email confirming the order. The purchase contract comes into effect through the written confirmation of purchase on the part of "Livingtools." Should you not receive confirmation of shipment or delivery itself within 2 weeks, you are no longer bound to your purchase.
Your orders will be stored by us. Should you lose your documents regarding your orders, please contact us by email, fax, or telephone (see Contact Information). We will gladly send you a copy of the details regarding your order.
We reserve the right to cancel orders placed by obvious resellers, especially during special sales. Should an item not be available for reasons having to do with "Livingtools," "Livingtools" reserves the right to deliver an item comparable in quality and price. Should an item unexpectedly undeliverable for reasons having nothing to do with "Livingtools," "Livingtools" has the right to withdraw from the transaction.
4. Right of Withdrawal
You can withdraw from the transaction within one month without cause in written form (e.g., letter, fax, email to info@tischtools.de) or by returning the goods, unless the transaction was carried out within your professional capacity (ordering via a firm). The time limit starts at the earliest with the receipt of goods and a written notice. The time limit is preserved by the timely return of goods or the sending of the declaration of withdrawal. The goods must, if possible, be in a condition to be resold. In case of deterioration (e.g. through obvious signs of use) or destruction of the goods before returning, the depreciation or cost of the goods is the responsibility of the customer. The right of return is preserved through the timely sending of received goods or through written declaration to "Livingtools." The purchase contract is dissolved by timely return of goods. Payments already made will be transferred to your account within 14 days. The goods being returned should be in original packing to the extent possible, in any case in transport-safe packaging, including stable cushioning and with a copy of the invoice. Damages and delays due to neglect of these guidelines are the responsibility of the customer.
You must bear the expense of returning the goods when the goods are those ordered and when the sum does not exceed 40 Euro, or in case the price of the goods is higher at time of return, you have not produced the difference or a contractually-agreed partial payment.
5. Guarantee
You agree to advise "Livingtools" of any obvious defect of the goods, including damage during transportation, immediately - within two weeks after delivery of goods at the latest. Neglect of this deadline obviates right of guarantee due to obvious defects. Defects that cannot be discovered by careful inspection within this deadline are to be communicated to us immediately upon discovery. Valid complaints of obvious defects within two weeks of delivery, or of other defects within two years of delivery, entitle the customer to repair or replacement, according to the wishes of the customer, of the goods free of charge. Should the repair or replacement fail, you can demand reduction of remuneration or cancellation of the purchase contract.

"Livingtools" delivers the goods to the address given. The purchaser bears the costs of shipping. These are set out in the confirmation of order. Should an item sent within the framework of the gift services not be accepted, "Livingtools" permitted to bill for a second delivery, to the sum of the original delivery. "Livingtools" is also permitted to demand reimbursement of bank fees in the sum of 10 euros or the cost of expenditures arising from the use of incorrect account or credit card numbers.
Dispatching time is written beside the article price. Delivery time depends of the target destination. Within Germany your order will reach you normaly 2 days after dispatching. Please note that with renewed payment - upon receipt orders a fee of 2 euros will be charged for the new shipping costs. Should the goods not be accepted despite absence of right of withdrawal, "Livingtools" is entitled to demand a fee in the sum of 10% of the cost of the goods, with a minimum of 10 euros being charged.

We accapt payment in advance, payment at delivery, PayPal or via credid card. If you choose payment via credit card the ammount is drawn from your card right after you finnished your order. By foreign country first orders and paying with credit card we need a copy of the credit card front side and a valid identity card as well in order to verify the legal holder of the credit card. Until complete payment is made, the goods remain the property of "Livingtools." In case of faulty or double billing we will immediately reimburse you for the overcharge. Further reimbursement is excluded.
8. Liability
"Livingtools" is only responsible for damages due to intent or gross negligence. "Livingtools" is responsible for culpable actions of its employees in the case of violations of substantial contract obligations. "Livingtools" functions as a trading concern, not a manufacturer.
"Livingtools" is not responsible for indirect damages, especially for lost profits, unless these damages are the result of intentional acts of employees or intent and gross negligence of legal representatives and managers of "Livingtools."
Except in the case of intentional acts of employees or intent and gross negligence of legal representatives and managers of "Livingtools," liability is limited to the sum of typically foreseeable damages. "Livingtools" takes no responsibility for the constant and uninterrupted presence of the internet or for technical or electronic mistakes of online offers. "Livingtools" takes no responsibility for damages incurred by purchases through use of the consumers password by unauthorized parties.
9. Violations, changes, and legal information
The customer can take back his registration at "Livingtools" at an time, as long as all transactions have been settled.
In case of violations against the terms of use, "Livingtools" reserves the right to exclude the customer without notice from further transactions.
For consumers in EU countries, the local laws of that country can be applicable, as far as consumer laws are concerned.

All customer information is stored and processed according to the relevant guidelines of the German Federal Privacy Protection Law (Bundesdatenschutzgesetz, BDSG) and the Teleservice Privacy Protection Law (Teledienstdatenschutzgesetz, TDDSG). We will not give your information, including address and email address, to a third party without your express permission, which you can revoke at any time.
